Baumeister Privacy Policy

This Privacy Policy explains how Baumeister Private Server, Inc., a Delaware corporation (“Baumeister,” “we,” “us,” or “our”), collects, uses, and shares information when you use the Baumeister website-building and hosting platform (the “Service”). This Policy is incorporated into our Terms of Service. If you do not agree with this Policy, do not use the Service.

1. Information We Collect

Information from your site visitors (Message Portal)

When a visitor submits a message through a form on your published site, we collect the information the visitor provides (for example, name, email, and message) and make it available to you, the site owner. As to that visitor information, you are the controller and we act as your processor: you decide how the information is used, and we process it on your behalf to deliver it to you and to operate the Message Portal. You are responsible for handling that information in compliance with applicable privacy laws.

Buyers on seller storefronts

When you buy from a site built on Baumeister, the site owner (“seller”) is the merchant. Payment is processed by Stripe, which collects and holds your payment card details directly; Baumeister does not receive or store card numbers. Baumeister stores the order information the seller needs to fulfill your purchase — your name, email, shipping address (if provided), order notes, and amount — on the seller’s behalf, and shares it with the seller. The seller is responsible for how they use your information. We retain order records for up to two years. Stripe’s handling of payment data is governed by Stripe’s Privacy Policy.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share information only as described below.

We share information with vendors that help us operate the Service, under contracts that limit their use of the information to providing services to us. Our current providers are:

Legal and compliance

We may disclose information when required by law or legal process, or when we believe disclosure is necessary to protect the rights, safety, or property of Baumeister, our users, or the public, or to protect the integrity of the Service.

Business transfers

If we are involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to this Policy.

4. AI Processing

To generate and edit your site, your inputs (such as your business description and current site content) are sent to our AI provider, Anthropic, PBC, which processes them to return output to you. Under Anthropic’s commercial API terms, Anthropic does not use the inputs or outputs from the Service to train its AI models. You are responsible for reviewing AI-generated content before you publish it.

5. Data Retention

We retain your information for as long as your account is active and as needed to provide the Service. After your account is closed, we retain information for a reasonable period for backups, security, dispute resolution, and legal compliance, then delete or de-identify it. You may request deletion as described in Section 6. Message Portal information is retained according to your settings and instructions as the controller of that information.

6. Your Privacy Rights and Choices

Depending on where you live, you may have rights regarding your personal information. We honor these rights as required by applicable law, and we will not discriminate against you for exercising them.

Rights that may be available to you

California residents (CCPA/CPRA)

In the twelve months before the date of this Policy, we collect the following statutory categories of personal information: identifiers (such as your email address and a customer identifier); commercial information (such as subscription and transaction records); internet or other electronic network activity (such as usage logs); and other information you choose to provide as Content. We collect this information from you directly and automatically through your use of the Service, and we use it for the business purposes described in Section 2. We do not sell personal information, and we do not share it for cross-context behavioral advertising. We do not use or disclose sensitive personal information for purposes that require a right to limit. California residents have the right to know, access, correct, and delete their personal information, and the right not to receive discriminatory treatment for exercising these rights.

Other United States state privacy laws

Residents of Virginia, Colorado, Connecticut, Utah, Texas, and other states with comprehensive privacy laws may have rights to access, correct, delete, and obtain a portable copy of their personal information, and to opt out of the sale of personal information, targeted advertising, and certain profiling. Where these laws provide a right to appeal a decision on your request, you may appeal by replying to our response or by contacting us at the address in Section 12.

EU and UK residents

The Service is offered from and directed to users in the United States. It is not directed to individuals in the European Economic Area or the United Kingdom, and we do not intentionally offer the Service to or monitor individuals in those regions. If we begin serving those regions, we will update this Policy to describe the legal bases for processing and the safeguards for international data transfers.

How to exercise your rights

To exercise any of these rights, contact us at info@baumeisterprivateserver.com. We will verify your request using the email address associated with your account and respond within the time required by applicable law. You may use an authorized agent to submit a request where the law permits, and we may require the agent to provide proof of authorization.

7. Cookies and Do Not Track

We use browser local storage only to keep you signed in and to operate core features of the Service. We do not use advertising or cross-site tracking technologies. Because there is no consensus standard for how to respond to browser “Do Not Track” signals, the Service does not respond to them; this has no effect on your experience, because we do not track you across other websites.

8. Security

We use reasonable technical and organizational measures to protect information, including encryption of information in transit and storage of credentials and secrets in protected systems. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping access to your email account secure, because it controls magic-link sign-in to your account.

9. Children’s Privacy

The Service is intended for users who are at least 18 years old, and it is not directed to children. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete it. If you believe a child has provided us with personal information, contact us at the address in Section 12.

10. Where We Operate

We operate the Service in the United States, and the information we collect is processed and stored in the United States. If you access the Service from outside the United States, you understand that your information will be processed in the United States, where privacy laws may differ from those in your location.

11. Changes to This Policy

We may update this Policy from time to time. We will post the updated Policy with a new “Last updated” date, and for material changes we will provide additional notice, such as by email or in-product notice. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Policy.
